TL;DR

  • Nintendo targeted Switch emulators on GitHub with DMCA takedown requests last month.
  • Eden developers claim that GitHub ignored the legal steps taken to insulate the project.
  • While the project may never return to GitHub, a cloned repository allows work to continue.

Nintendo continues to protect its IP aggressively, especially for profitable consoles like the Switch. Recently, the company sent DMCA infringement notices to all major Switch emulators hosted on GitHub. The Eden team has now provided an update on the situation.

As noted in earlier coverage, developers anticipated this move and duplicated their code and assets off GitHub to mitigate impact. Eden’s developers also took legal steps to make the project resistant to Nintendo’s DMCA claims. However, they say GitHub did not respond to their counterclaims and shut the repository down as soon as Nintendo requested it.
