The Monday decision follows an appeal by Stephen Thaler, a computer scientist from Missouri, challenging a lower‑court ruling that upheld the view that AI‑generated art cannot be copyrighted.
In 2019, the U.S. Copyright Office rejected Thaler’s request to copyright an image titled “A Recent Entrance to Paradise,” which was created by an algorithm he developed. After reviewing the decision in 2022, the Copyright Office concluded that the image lacks “human authorship,” disqualifying it from copyright protection.
