The Department of Government Efficiency’s cancellation of over $100 million in grants was ruled unconstitutional by U.S. District Judge Colleen McMahon. In her 143‑page decision, the judge highlighted the agency’s (referred to as “DOGE”) process for eliminating grants, which relied on ChatGPT to assess whether a project was related to diversity, equity, and inclusion (DEI).
The ruling stems from a 2025 lawsuit filed by humanities groups, including the National Endowment for the Humanities (NEH). Judge McMahon wrote that “it could not be more obvious that DOGE used the mere presence of particular, protected characteristics to disqualify grants from continued funding.”
